Crewed Yacht Charter Conditions
MYBA Terms
For a large majority of crewed yachts, we draw MYBA (Mediterranean Yacht Brokers Association) charter contracts.
Under MYBA Terms the Charter Rate includes the hire of the yacht with all its equipment in working order, tools, stores, cleaning material and basic consumable stores for engine-room, deck and cabins, etc., the crew's wages, food and the yacht's insurance for marine risk and third party claims and the crew's for employer's liability insurance.
The Charterer will be charged extra for all other expenses, at cost to the yacht.
These expenses include fuel for the yacht and its tenders, food and drinks for the Charterer's party, other consumable stores, berthing dues and other harbour charges, including pilotage fees and water and/or electricity taken from the shore, laundry, phone, fax or email connection costs, hire costs of special equipment placed on board at Charterer’s request.
Please see APA hereunder.
These charter terms are also accepted by CYBA (Charter Yacht Brokers Association).

Additional Expenses - APA
When chartering a Crewed Yacht under MYBA Terms, the Charterer is required to make an expense deposit in advance of the charter.
This deposit is called the "Advance Provisioning Allowance" or APA and is generally estimated at 30% of the Charter Fee.
It is used to cover Charterer’s expenses not included in the Charter Fee. In the event of cancellation of the charter the APA is refundable.
The Captain of the yacht is responsible for all APA expenses during the charter, and the breakdown will be presented to the Charterer in a clear manner at the end of the charter.
If the costs incurred during the course of the charter are less than the APA deposit, then the difference will be refunded to the Charterer at the end of the charter.
If the costs incurred during the course of the charter are over and above the APA deposit then this difference will be payable by the Charterer during the cruise directly to the Captain at his request or at the end of the charter.

VAT Tax
European Union law requires yachts operating in the national waters of the Union to collect Value Added Tax (VAT/TVA/IVA, etc.) on all charters at rates which vary between 4% to 20.6% of the Charter Rate. This is payable by the Charterer.
However, there are still various interpretations from country to country and some yachts which have been placed under Commercial Registry may not be required to collect the tax. This is currently under review, so do please check with us for up-to-date information.
Under the same rule exemptions, some yachts may be allowed to purchase taxfree fuel.

Payment Schedule
Normally, you will be asked to pay 1/2 of the charter fee upon signing the contract, and the remaining 1/2 plus APA approximately 30 days before the charter begins. The charter will not begin until all payments are made.
How to Pay ?
Payments for the booking of Yacht Charters are generally made via bank wire transfer to our Charter account.
For smaller charter amounts we also accept credit card payments, however in this case, handling fees of 2 to 4% may be added.

Tipping ?
Tipping is customary but depending on your staisfaction with the crew's performance at charter end. Common tipping practice on Crewed Yachts is normally 5% to 15% of the total charter rate. Some regional differences exist – for yachts working in the Caribbean 10 to 15% is customary while for yachts working in the Med or other parts of the world. 5 to 10% is usual.
We suggest that tips be given to the Captain who will distribute them to all crew members including the ones you may not have met during the charter - Mechanics, Laundry Personnel – who have equally ensured a smooth charter throughout.
